Bank loans and riba al-fadl

Buying and selling money today takes the form of borrowing from a bank on interest. It is a form of riba known as riba al-fadl and is strictly prohibited! The Prophet (s) is reported to have made mention of two precious metals (gold and silver) and four commodities (wheat, barley, dates and salt) and prohibited any transaction of like for like which is not also equal for equal and hand to hand (i.e. no credit) in so far as these metals and commodities were being traded. Any violation of that law would entail riba:

Ubada bin al-Samit retried Allah's Messenger as saying: Gold is to be paid for by gold, silver by silver, wheat by wheat, barley by barley, dates by dates and salt by salt, like for like and equal for equal, payment being made on the spot. If these classes differ (i.e. if it is not like for like) sell as you wish if payment is made on the spot.

Abu Said al-Khudri reported Allah's Messenger as saying: Gold is to be paid for by gold, silver by silver, wheat by wheat, barley by barley, dates by dates and salt by salt, like for payment being made on the spot. If anyone gives more or asks more he has dealt in riba. The receiver and the giver are equally guilty.

Abu Said and Ahu Huraira told that Allah's Messenger appointed someone a governor over Khaibar. When the man came to Madina he brought him dates of a very fine quality called janib. The Prophet asked him: Are all the dates of Khaibar of this kind? The man replied: No! Oh messenger of Allah we exchange two s’as of bad dates for one s'a of this kind of dates (i.e. Janib), or exchange three s’as for two. On that, the Prophet said: Do not do so, as it is a kind of riba. But sell the dates of inferior quality for money, and then buy janib with the money. The Prophet said the same thing about dates sold by weight.

Abu Said al-Khudri said; Once Bilal brought barni (i.e. a kind of dates) to the Prophet and the Prophet asked him: From where have you brought these? Bilal replied I had some inferior type of dates and exchanged two s'as of it for one s’a of barni dates in order to give it to the Prophet to eat. There upon the Prophet said: Beware! Beware! This is definitely riba! This is definitely riba! Don’t do so, but if you want to buy (a superior kind of dates) sell the inferior dates for money and then buy the superior kind of dates with that money.

Abu Saeed said that Bilal brought the Prophet some barni dates, and when he asked him where he had gotten them he replied: I had some inferior dates so I sold two sa’s of them for one sa (of this). He said: Ah! The very essence of riba, the very essence of riba. Do not do so, but when you wish to buy, sell the dates in a separate transaction, then buy with what you get.

Yahya bin Sa’id reported that Allah's Messenger ordered the two Sa’ads to sell off all gold and silver plates obtained in booty (enemy property seized in warfare). They sold three plates for four (or four for three). The Prophet said: You have taken riba. Annul the sales.

Malik reported that it reached him from Qasim bin Muhammad that Umar bin al-Khattab said: A dinar far a dinar and a dirham for a dirham and a sa for a sa. Do not sell cash for credit.

Malik bin Aus bin Hadthan al-Nasri reported: I had need for changing one hundred dinars into dirhams. He said Talha bin Ubaidullah sent for me. We agreed on it (barter of gold and silver for gold and silver). He took gold from me and turned it over in his hands and said: Wait until my cashier arrives from Ghabah. Umar bin al-Khattab heard of this and declared: By Lord, do not leave him until you take money from him. He then said, the Prophet had said that the exchange of gold for silver is riba except when it is a cash transaction, the selling of wheat for wheat is riba except when it is a cash transaction, and the selling of dates for dales is riba except if it is a cash transaction, the selling of barley for barley is riba except when it is a cash transaction, and the selling of salt for salt is riba except when it is a cash transaction.

Ibn Shihab reported that Malik bin Aus said: I was in need of change for one hundred dinars. Talha bin Ubaidullah called me and we discussed the matter, and he agreed to change my dinars. He took the gold pieces in his hands and fidgeted with them, and then said: Wait until my store-keeper comes from the forest. Umar ibn al-Khattab was listening to that and said: By Allah you should not separate from Talha until you get the money from him, for the Prophet said: The selling of gold for gold is riba, except if the exchange is from hand-to-hand and equal in amount, and similarly, the selling of wheat for wheat is riba unless it is from hand to hand and equal in amount, and dates for dates is riba unless it is from hand to hand and equal in amount, and barley for barley is riba unless it is from hand to hand and equal in amount.

Abu Salih al-Zaiyat said: I heard Abu Said al-Khudri saying: The selling of a dinar far a dinar and a dirham for a dirham (is permissible). I said to him: Ibn Abbas does not say the same. Abu Said replied: I asked Ibn Abbas whether he had heard it from the prophet or had seen it in the holy book. Ibn Abbas replied: I do not claim that, and you know Allah's Messenger better than I do. But Usama informed me that the Prophet had said: There is no riba (in money exchange) except when it is not done hand to hand (i.e. when there is delay in payment).

The above ahadith have cleared some problems in understanding even for those who are teaching Islam in New York. In fact the implications are quite simple. If one person gives a loan of one gold dinar to another, then the contractual obligation for repayment of the loan should not exceed one gold dinar. Secondly, just as we need to buy French francs when we visit France, so too, in a market which uses real money, people need to buy money. Just as we may seek to buy the French francs with US dollars, so too, in a market which uses real money, we may seek to buy gold dinars with silver dirhams. Or we may wish to purchase a dozen larger size gold coins with a weight of one dozen ounces, with smaller size gold coins (and this is like changing five US$20. currency notes for a US$100. currency note. - with the exception that paper money is itself riba). Such money transactions, i.e. in which money is exchanged for money, are required to meet the condition of equal for equal and hand to hand in order to avoid riba.

It is of crucial importance for us to carefully note that while like for like required an equal for equal transaction which was also a transaction, when gold, silver, dates etc., were being bought and sold, this was not so for camels: 
Hassan bin Muhammad bin Ali bin Abi Talib reported that Ali bin Abi Talib sold his camel, named 'Usaifir, in return for Twenty camels (on credit).

Nafi' reported that Abdullah bin Umar boughs a she-camel in exchange for four camels and arranged that those four camels should be delivered to the owner at Rabdhah.

The reason for this was that camels were not used as money, while dates were sometimes used as money. And so four young-camels could be exchanged for one adult camel, but two baskets of inferior quality dates could not be exchanged for one basket of superior quality dates.

What would be the implication of the above ahadith if one were to take a bank loan in US dollars and were required to repay the loan in US dollars? This would be a like for like transaction involving something which, like gold, silver, wheat etc., is being used as a medium of exchange. Since it would be a like for like transaction, the Prophet (s) ordered that it be equal for equal. The hadith would thus prohibit bank interest charged on paper, plastic and electronic money.

It is my understanding that gold, silver, wheat, barley, dates and salt were mentioned by the Prophet (s) in connection with riba transactions because each of the these precious metals and commodities had served, or could serve, as a medium of exchange.

As a consequence it would follow that anything else, not mentioned in the hadith, which was adopted by mankind as a medium of exchange (i.e. or moneys would have the same restrictions applied to it.

This opinion appears to be supported by the following quote which appears in the muwatta of Imam Malik:
Abu Zinad reported that he heard Sa’id bin al-Musayyib saying: There is no riba but in gold and silver or in articles of consumption sold by weight or measure.

Thus a bank loan of US$1,000 in paper currency must require repayment of nothing more than the US$1.000 which was borrowed. Any repayment greater than US$1,000 which is stipulated as part of the loan agreement, would be riba. If the bank were to require of you that you must repay the $1,000 plus some additional amount (as interest, say 6 %) then that would be like for like but not equal for equal. It would thus most certainly be riba. This is so because US dollars are used as money in the form of a medium of exchange. It is, of course, another matter as to whether or not it is halal for us to use US dollars, or any other artificial money, as a medium of exchange. The answer is that paper money and all other forms of artificial money are themselves pure riba and therefore, haram for a Muslim. We have attempted to explain the reason for this in several places in this book. (See below: The Prophet, artificial money and inflation).

What can we do about it? Obviously we must strive to return to such money as is real money, and turn away from artificial money. The problem we face, however, is that gold appears to be indispensable to any effort of return to real money. And the enemy has seen to it that the bulk of the world’s supply of gold (both raw arid minted) is under their control.

رَبَّنَا  أَنزِلْ عَلَيْنَا مَآئِدَةً مِّنَ السَّمَاء تَكُونُ لَنَا عِيداً لِّأَوَّلِنَا وَآخِرِنَا وَآيَةً مِّنكَ وَارْزُقْنَا وَأَنتَ خَيْرُ الرَّازِقِينَ

روى أبو داود فى سننه من حديث مُجاهدٍ، عن سعد، قال: مَرضتُ مرضاً، فأتَانِى رسولُ الله صلى الله عليه وسلم يَعُودنى، فَوَضَعَ يَدَه بين ثَديَىَّ حَتَّى وَجَدتُ بَرْدَها على فؤادى، وقال لى:  إنَّكَ رجُلٌ مَفْؤُودٌ فأْتِ الحارَثَ بن كَلَدَةَ من ثَقِيفٍ، فإنَّه رجلٌ يتطبَّبُ، فلْيأْخُذْ سبعَ تَمَراتٍ من عَجْوَةِ المدينةِ، فلْيَجأْهُنَّ بِنَواهُنَّ، ثم لِيَلُدَّكَ بِهِنَّ

Abu Dawood narrated that Sad Radi Allaho Anh said, "Once I became ill and the Messenger of Allah Sallallaho Alaihe Wasallam came to visit me and placed his hand on the center of my chest, until I felt its coldness on my heart. He then said: "You ore complaining from your heart. Go to ­Harith bin Kaladah, (from the tribe) of Thaqhif for he knows about medicine. Let him take seven dates from ­Madinah's Ajwah; grind them with their seeds and then give them to you".


Dates in general and dried dates in particular, especially from Madinah Munawwarah, possess tremendous qualities and are especially effective in treating heart ailments. Using seven dates is another quality that can only be known through the revelation.


In the Sahihain, it is narrated that Sad bin Abi Waqqas Radi Allaho Anh reported that The Messenger of Allah said:


مَنْ تَصَبَّحَ بسبعِ تَمَرَاتٍ من تَمْرِ العَالِيَة لم يَضُرَّهُ ذلك اليومَ سَمٌ ولا سِحْرٌ



"Whoever eats seven dates from the area of Al­-Aaliah when he gets up in the morning then no poison or magic would harm him that day". 

In another narration, Prophet Muhammad Sallallaho Alaihe Wasallam said:


مَن أكل سَبْعَ تمراتٍ ممَّا بَيْن لاَبَتَيْها حينَ يُصبحُ، لم يَضُرَّهُ سَمٌ حتى يُمْسِى



"Whoever eats seven dotes produced between the two areas in Madinah (that are covered with burned black stones) in the morning, will not be harmed by poison until he reaches the night".


Dates are warm in the second degree and dry in the first degree. Dates constitute a good type of nutrition, especially for those whose regular diet contains dates, such as the people of Madinah. Dates are the best type of food for the residents of hot and mildly warm countries, more so than for the residents of cold areas who have an elevated inner temperature, whereas those in warm areas have a colder inner temperature. This is why the people in Hijaz, Yemen and Taif, and similar areas eat hot foods such as dates and honey. They use pepper and ginger in their food more than other areas; sometimes ten fold as much. Some of them even eat Zanjabeel (Ginger) just as other people eat sweets. They even transport these types of foods with them when traveling. As we have stated, these types of food are suitable for the residents of warm areas and do not harm them because of the lower inner temperature of their bodies. On a similar note, we should mention that well water becomes colder during summer and warmer during winter. Furthermore, the stomach digests thick (or complex) foods in winter more than during summer.


For the people of Madinah, dried dates are their staple like wheat is to other people. In addition, dried dates from the area of Al-Aaliyah in Madinah are one of the best kinds of dates because they are firm, delicious and sweet.


Dates are a type of fruit that is used for its nutritional and medicinal value, being favorable for most bodies and for their role in strengthening the natural heat. In addition, dates do not produce harmful wastes or excrements such as the other types of foods and fruits. Rather, dates preserve the bodily wastes from being spoiled and from rotting, especially for those used to eating dried dates.


The Hadith we mentioned about dried dates (in the beginning of the chapter) is specifically for the people of Madinah and surrounding areas. It is a fact that the medicinal value of the herbs and plants that grow in certain areas is closely related to the quality of the air and the type of soil in those areas. A certain medicinal herb might be useful in its natural habitat but not if it is grown elsewhere. The various lands differ in their nature and characteristics, just as people differ from each other. Sometimes, a certain type of plant might be a regular staple in the diet in a certain area, while it is poisonous in other areas. Sometimes, certain remedies that people use in a certain land might be a regular staple for other people in another area. Some types of medicine might provide a cure for some illnesses for some people; while curing other kinds of diseases for other people.


Using seven dates has a spiritual and material significance. Allah Has Created seven heavens, seven earths, seven days in the week and Made the creation of mankind pass through seven stages. In addition, Allah Made the Tawaaf seven circumambulations; and the Sa'ee as seven trips between Safa and Marwah. In addition, the Jamraat are stoned with seven pebbles each. Prophet Muhammad Sallallaho Alaihe Wasallam said about young children,


"Command him to pray upon reaching the age of seven".



In addition, when the child reaches the age of seven, he is given the choice between his father and mother, according to some opinions. When our beloved Prophet was ill, he ordered that water be poured on him from seven different water skins. Allah Has Sent the destructive wind on the people of Aad for seven consecutive nights. Furthermore, when Allah Gave the example of charity, He compared it to a grain (of corn); it grows seven ears, and each ear has a hundred grains. In addition, the ears of corn that the king saw during the time of Prophet Yusuf (Joseph) were seven and the number of the years during which the king’s people would farm the land was seven. Charity is multiplied seven hundred times to much more. Further, there are seventy thousand members of the Muslim Ummah (Nation) who will enter Jannah (Paradise) without questioning. The number seven has a special significance more than other numbers and only Allah Has full knowledge of the wisdom behind choosing this number above other numbers.


The Hadith mentioned that eating seven dates from a certain area in Madinah prevents poisoning and magic, indicating the special qualities of this type of date. Had it been Hippocrates or Galinus who issued this statement rather than the Prophet, the doctors would quickly accept the statement without question, even though they would be issuing it based on guessing and not on fact. The statements that come from our beloved Prophet, whose words are certainly true and divinely revealed, deserve to be believed in more and submitted to, without any hesitation or denial.


The dried dates mentioned in Hadith are being useful against certain poisons. Furthermore; we should state here that it is a condition that the sick person should believe that the medicine will help him, so that his body accepts it and benefits from it. It is a fact that sometimes (merely believing), the medicine will help cure some ailments, as many people have witnessed in this regard. When the heart accepts that a certain medicine carries the cure, the body will feel an elevation in its strength and in the instinctive heat that will help the body get rid of and extract out the harmful substances. On the other hand, sometimes an effective medicine fails to work because the patient does not believe that it will cure him, and consequently, his body neither accepts it, nor benefits from it.


Even the Quran, which is the best, most beneficial remedy ever, both in this life and in the Hereafter, and which is a cure for every disease, will not benefit the heart that does not believe in its value as a cure and a remedy. Rather, the Quran only adds more disease to such evil hearts.


There is not a more effective cure for the diseases of the heart than the Quran, for it completely eradicates the ills of the heart, preserves the heart’s health and wellbeing and defends it against all that might bring harm to it. Yet, most of the hearts ignore the Quran and do not believe in it, and thus refrain from using it. Instead, such people refer to other types of medicine that were prepared by their like from among mankind, thus preventing their hearts from benefiting from the Quran. Consequently, the symptoms that attacked their hearts will persist and will expose their hearts to even more ailments. By the passage of time, both the doctors and the patients will get used to the medicines produced and prescribed by their like, leaders, or those whom they respect. In this case, disasters will accumulate and the diseases will become harder to cure. And the more they (those who ignore the Quran) use these medicines, the more strength they will add to the ailment.

حلبة : ذكر عن النبي ـ صلى الله عليه وسلم ـ ‏(‏أنه عاد سعد بن أبي وقاص  رضي الله عنه بمكة، فقال‏:‏ ادعوا له طبيبًا، فدعي الحارث بن كلدة، فنظر إليه،  فقال‏:‏ ليس عليه بأس، فاتخذوا له فريقة، وهي الحلبة مع تمر عجوة رطب يطبخان،  فيحساهما، ففعل ذلك، فبرئ‏)‏‏.‏

وقوة الحلبة من الحرارة في الدرجة الثانية، ومن اليبوسة في الأولى،  وإذا طبخت بالماء، لينت الحلق والصدر والبطن، وتسكن السعال والخشونة والربو، وعسرالنفس، وتزيد في الباه، وهي جيدة للريح والبلغم والبواسير، محدرة الكيموسات  المرتبكة في الأمعاء، وتحلل البلغم اللزج من الصدر، وتنفع من الدبيلات وأمراض الرئة، وتستعمل لهذا الأدواء في الأحشاء مع السمن والفانيذ  وإذا شربت مع وزن خمسة دراهم فوة، أدرت الحيض، وإذا طبخت، وغسل بها  الشعر جعدته، وأذهبت الحزاز‏.‏ ودقيقها إذا خلط بالخل، وضمد به، حلل ورم الطحال وتستعمل لهذا الأدواء في الأحشاء مع السمن والفانيذ

وهي نافعة من الحصر، مطلقة للبطن، وإذا وضعت على الظفر المتشنج أصلحته، ودهنها ينفع إذا خلط بالشمع من الشقاق العارض من البرد ويذكر عن القاسم بن عبد الرحمن، أنه قال‏:‏ قال رسول الله ـ صلى الله عليه وسلم ـ‏:‏ ‏(‏استشفوا بالحلبة‏)‏‏.‏ وقال بعض الأطباء‏:‏ لو علم الناس منافعها، لاشتروها بوزنها ذهبًا‏.‏



Prophet Muhammad Sallallaho Alaihe Wasallam was reported to have visited Sa'ad bin Abi Waqqas Radi Allaho Anh once when he was ill while in Makkah and he asked that a doctor be brought to examine him. They brought Harith bin Kaladah who examined him and said, ‘There is no harm with him, just cook some fenugreek with dates and let him eat them. Sa'ad was reported to have done that and was then healed.


Hulbah (Fenugreek) is hot in the second degree and dry in the first degree.


When fenugreek seeds are cooked in water, they will soften the throat, chest and the stomach. It relieves coughing, dryness, asthma, hard breathing and increases the sexual drive. It also relieves flatulence, phlegm, piles and the various accumulations in intestines. Fenugreek seed dissolves the phlegm from the chest and helps against gastric ulcer and lung diseases. Hulbah is used to heal the intestines, mixed with some ghee and Faloodah.


When five measures of fenugreek are taken as a drink, it will increase the flow of menstruation, and when it is cooked and the hair is washed with it, it will make it curly and will combat dandruff.


When the flour of the fenugreek seeds is blended with some vinegar and used as a bandage on the tumor of spleen, it will dissolve it. In addition, the woman who suffers from pain in the vagina due to a tumor will benefit if she sits in the water in which the fenugreek was cooked.


When it is used as a bandage and placed on hard / cold tumors, it will help dissolve these tumors. When its water is drunk, it will help against the pain in the stomach that results from accumulation of gaseous materials and will cleanse the intestines.


When one eats the Hulbah cooked in honey, dates or figs on an empty stomach, it will dissolve the phlegm that accumulates in the chest and stomach, and will help against coughing that accompanies such ailments.


Hulbah relieves urine retention and works as a laxative. When it is placed on the erratic nail, it will heal it, while its oil helps against cracked skin due to extreme cold (when it is mixed with wax). There are many other benefits for the Hulbah (Fenugreek).


Reported by Qasim Bin Abdul Rahman that Prophet Muhammad Salallaho Alaihe Wasallam said : "Seek the Shifa (healing) with Hulbah".


Some doctors stated, "If the people had knowledge of its benefits, they would buy it with its weight worth of gold".
