The prohibition of riba in the Torah




THE PROHIBITION OF RIBA IN THE TORAH

After the revelation of the verse of al-Rum the next revelation of the Qur’an in which riba is targeted by name, is located in Surah an-Nisa (Qur'an:- 4:161). In it the Qur’an condemned the Jews for consuming riba. Again, as in the previous revelation on the subject, riba referred to usurious investments or lending on interest. Thus revelation came down shortly after the Hijrah, when the Prophet (s) was living in the midst of Jews in Madinah.

Madinan society appears to have been permeated and saturated by riba and the Jews of Madinah appear to have dominated the market for lending on interest. Makkah was a prosperous commercial center and riba in Makkan society was almost exclusively manifested in production loans which tribes, as corporate entities, would take for the purpose of raising capital to increase business. The tribe in turn took care of the needs of its individual members who were in need. Madinah economy was much poorer on the other hand and was almost exclusively agricultural and pastoral. Riba in Madinah extended beyond production loans to also include consumption loans, i.e. loans sought by those who were in need.

The extern of the penetration of riba into the pre-Islamic economy of Madina was graphically depicted by the Jewish convert to Islam, the Rabbi Abdullah bin Salaam;

Abu Burda said: I met Abdullah bin Salaam, He said .... You are in a territory (i.e. Madina) where the practice of riba is prevalent; so if someone owes you something and he sends you a present of a load of chopped straw or a load of barley or a load of provender, do not take it, for it is riba.
(Bukhari)

It would appear that the revelation on riba in Surah al-Nisa must have played a significant role in the Jewish rejection of the prophethood of Muhammad (s). And Allah the Most High, knows best! The revelation condemned the Jews for taking riba: although it had been prohibited for them (by Allah the Most High). It castigated such conduct as disbelief (kufr). And it warned of a truly terrible punishment which would be visited upon those who commit such kufr.
            
So then, for the wickedness committed by those who follow the Jewish faith, did We deny unto them (in the Torah) certain of the good things of life (e.g. certain foods) which previously were permitted for them; and (We did this) for their having led so many astray from the path of Allah.

And for their taking riba (usury) although it had been forbidden to them and (in consequence of taking riba) their wrongful acquisition of the wealth of others (which is really cheating and robbing people of their wealth). And for those Jews who reject Truth (by taking riba) We have prepared a terrible, terrible punishment.

But those among (the Jews) who penetrate knowledge, as well as those (Muslims who follow Muhammad) who believe in that (i.e. the Qur’an) which was revealed to thee (i.e. Muhammad), as well as that which was revealed previously (both of which prohibit riba) . . .
(Qur’an: al-Nisa 4:160-163)

The education provided in this revelation was quite startling. It described the profit from riba-based investments as the unlawful appropriation of other peoples’ wealth. This charge was already present in the first revelation (i.e. . . . seeking increase through the wealth of others . . .). This was cheating. This was theft. Usury was therefore immoral. It was a violation of justice. In a riba-based economy, as a consequence, those who pay riba will become poorer and poorer. On the other hand, whatsoever is used for charitable purposes will be returned by Allah the Most High. It is Allah the Most High, Who apportions rizq (wealth which is provided by Allah the Most High). When a borrower spends from that rizq to pay riba (such as ' interest’ on a loan) that will not be replaced by Allah the Most High. The lender’s gain is the borrower's loss!

But the revelation did more than repeal the iniquity of riba. It directed attention to the Jews and disclosed that they had been forbidden from taking riba and that they had violated that prohibition. Indeed in an earlier revelation at the beginning of Surah al-Baqarah, Allah the Most High, accused the Jews of changing the Word of Allah the Most High in order to derive financial benefit:

O! Banu Israil, remember the favors which I bestowed upon you. Be faithful to your covenant with me, and I will be true to My covenant with you. Have faith in that which I have (now) revealed (i.e. the Qur’an) which confirms your scriptures. Do not be the first to reject it (i.e. the Qur’an). And do not sell My revelations for a paltry price and guard yourselves from Me.
(Qur’an al-Baqarah:-2:40-43)

An examination of the Torah reveals the changes: In the Book of Leviticus, the Torah addresses the subject of riba:

If your brother Israelite meets with difficult times and you give shelter and lodging as though he were an alien guest, let him live with you and do not exact from him any interest (riba) over and above that which you have spent on him. You have the anger of God to fear. See to it that your brother has freedom to live, with you. It is not permissible for you to receive interest (riba) on what you spend or what you write off.
(Leviticus 25:35-37)

Again in the Book of Exodus, the Torah deals with riba:

And if you lend money to some poor neighbor among My people, do not drive him hard as extortioners do, nor burden him with interest (riba).
(Exodus:-22:24)

And finally the Torah addressed the problem of riba in the Book entitled Deuteronomy:

Do not charge interest (riba) to the fellow-Israelite when you lend him money or grain or anything else. You may charge interest (riba) when you make loans to foreigners (i.e. gentiles). To your brother you shall lend without interest (riba) all that he needs, so that the Lord, your God may bless you ...
(Deuteronomy:-2d: 19-20)

A comparison of the Qur’anic verse with its stinging denunciation of the Jews for consuming riba and the verses in the Torah which permit the Jews to charge riba from non-Jews, leads us to the unambiguous conclusion that the text of the Torah was changed.

The Qur’an confirms this:

But the wicked (people) changed the text which had been given to them....
(Qur’an: al-Baqarah:- 2:59)

Woe unto those who write the (revealed) Book with their own hands, and then say: This is from Allah in order to acquire a trifling gain. Woe unto them for what their hands have written, and woe unto them for all that they may have gained.
(Qur’an: al-Baqarah:- 2:79)

The punishment for this scriptural crime will be terrible indeed:

Verily as for those who suppress ought of the revelation which Allah has bestowed from on high (and this includes concealing the prohibition against riba by corrupting the text of she scripture), and barter it away for a trifling gain - they but fill their bellies with fire. Allah will not speak to them on the Day of Resurrection nor will He cleanse them (of their sins) and a truly terrible punishment awaits them.
(Qur’an: al-Baqarah;- 2:174)

We should here recall that the Qur’an had indirectly addressed the subject of riba in the very early Makkan Surah entitled the Scandal-Mother (al-Humaza) and that the revelation denounced riba as a form of scandalous and sinful behavior which provoked
Allah’s anger:

Woe to every scandal-monger (i.e. each and every one of them, and also each and every form of scandalous behavior); (Among the different types of scandal-mongers is) he who amasses wealth and realizes its constant increase; (always. increase and never decrease); (or who counts on his wealth as a safeguard); He believes that his wealth will last forever (i.e. that he will remain permanently rich. In other words he feels that he has succeeded in blocking all avenues through which anyone, including Allah can ever reduce his wealth or ever make him poor. And that is precisely the ultimate objective of those who establish and sustain the system of riba).

By no means (will his wealth save him)! He will surely be thrown into al-Hutamah (i.e that which will smash him to bits). And what will explain to you al-Hutamah? (It is) the fire of (Allah's anger) which has been kindled (to a blaze). (A fire) which ascends to the very heart. It shall surely be over them like a vault rising in columns outstretched. (They will choke and suffocate in that terrible fire).
(Qur’an: al-Humazah:-l04:1-8)

And so, when the Qur’an identified the Jews by name and denounced them for their riba and the scriptural crime which permitted it, it must have had a truly shattering impact on their obstinate psyche. We must remember that the Qur’anic denunciation of Jewish misconduct was truly powerful:

(They are fond of) listening to falsehood (and) of devouring ill-gotten wealth (obtained through the exploitation of others)
(Qur’an. al-Maidah; -5:45)

And thou shall see many of them (Jews) hastening towards sin and transgression and their devouring of ill-gotten wealth (obtained through the exploitation of others). Vile indeed are the things that they do.
(Qur’an: al-Maidah:-5:65)

We should also remember that the Quran singled out their rabbis and took them to task asking why were they not doing something to prevent this scandalous conduct:

Why do the Rabbis and the Doctors of Law not forbid them from their habit of uttering sinful words and consuming ill-gotten wealth (obtained through the exploitation of others)? Evil indeed ore their works.
(Qur’an: al-Maidah:-5:66)

When the Qur’anic revelation denounced the Jews for their consuming riba although it had been prohibited for them (4:161) the Qur’anic reference was not restricted to the Torah. Other Prophets of Allah the Most High, besides Moses had prohibited the Jews from consuming riba. And so Jews were violating the commands of those Prophets as well.

رَبَّنَا  أَنزِلْ عَلَيْنَا مَآئِدَةً مِّنَ السَّمَاء تَكُونُ لَنَا عِيداً لِّأَوَّلِنَا وَآخِرِنَا وَآيَةً مِّنكَ وَارْزُقْنَا وَأَنتَ خَيْرُ الرَّازِقِينَ

روى أبو داود فى سننه من حديث مُجاهدٍ، عن سعد، قال: مَرضتُ مرضاً، فأتَانِى رسولُ الله صلى الله عليه وسلم يَعُودنى، فَوَضَعَ يَدَه بين ثَديَىَّ حَتَّى وَجَدتُ بَرْدَها على فؤادى، وقال لى:  إنَّكَ رجُلٌ مَفْؤُودٌ فأْتِ الحارَثَ بن كَلَدَةَ من ثَقِيفٍ، فإنَّه رجلٌ يتطبَّبُ، فلْيأْخُذْ سبعَ تَمَراتٍ من عَجْوَةِ المدينةِ، فلْيَجأْهُنَّ بِنَواهُنَّ، ثم لِيَلُدَّكَ بِهِنَّ

Abu Dawood narrated that Sad Radi Allaho Anh said, "Once I became ill and the Messenger of Allah Sallallaho Alaihe Wasallam came to visit me and placed his hand on the center of my chest, until I felt its coldness on my heart. He then said: "You ore complaining from your heart. Go to ­Harith bin Kaladah, (from the tribe) of Thaqhif for he knows about medicine. Let him take seven dates from ­Madinah's Ajwah; grind them with their seeds and then give them to you".


Dates in general and dried dates in particular, especially from Madinah Munawwarah, possess tremendous qualities and are especially effective in treating heart ailments. Using seven dates is another quality that can only be known through the revelation.


In the Sahihain, it is narrated that Sad bin Abi Waqqas Radi Allaho Anh reported that The Messenger of Allah said:


مَنْ تَصَبَّحَ بسبعِ تَمَرَاتٍ من تَمْرِ العَالِيَة لم يَضُرَّهُ ذلك اليومَ سَمٌ ولا سِحْرٌ



"Whoever eats seven dates from the area of Al­-Aaliah when he gets up in the morning then no poison or magic would harm him that day". 

In another narration, Prophet Muhammad Sallallaho Alaihe Wasallam said:


مَن أكل سَبْعَ تمراتٍ ممَّا بَيْن لاَبَتَيْها حينَ يُصبحُ، لم يَضُرَّهُ سَمٌ حتى يُمْسِى



"Whoever eats seven dotes produced between the two areas in Madinah (that are covered with burned black stones) in the morning, will not be harmed by poison until he reaches the night".


Dates are warm in the second degree and dry in the first degree. Dates constitute a good type of nutrition, especially for those whose regular diet contains dates, such as the people of Madinah. Dates are the best type of food for the residents of hot and mildly warm countries, more so than for the residents of cold areas who have an elevated inner temperature, whereas those in warm areas have a colder inner temperature. This is why the people in Hijaz, Yemen and Taif, and similar areas eat hot foods such as dates and honey. They use pepper and ginger in their food more than other areas; sometimes ten fold as much. Some of them even eat Zanjabeel (Ginger) just as other people eat sweets. They even transport these types of foods with them when traveling. As we have stated, these types of food are suitable for the residents of warm areas and do not harm them because of the lower inner temperature of their bodies. On a similar note, we should mention that well water becomes colder during summer and warmer during winter. Furthermore, the stomach digests thick (or complex) foods in winter more than during summer.


For the people of Madinah, dried dates are their staple like wheat is to other people. In addition, dried dates from the area of Al-Aaliyah in Madinah are one of the best kinds of dates because they are firm, delicious and sweet.


Dates are a type of fruit that is used for its nutritional and medicinal value, being favorable for most bodies and for their role in strengthening the natural heat. In addition, dates do not produce harmful wastes or excrements such as the other types of foods and fruits. Rather, dates preserve the bodily wastes from being spoiled and from rotting, especially for those used to eating dried dates.


The Hadith we mentioned about dried dates (in the beginning of the chapter) is specifically for the people of Madinah and surrounding areas. It is a fact that the medicinal value of the herbs and plants that grow in certain areas is closely related to the quality of the air and the type of soil in those areas. A certain medicinal herb might be useful in its natural habitat but not if it is grown elsewhere. The various lands differ in their nature and characteristics, just as people differ from each other. Sometimes, a certain type of plant might be a regular staple in the diet in a certain area, while it is poisonous in other areas. Sometimes, certain remedies that people use in a certain land might be a regular staple for other people in another area. Some types of medicine might provide a cure for some illnesses for some people; while curing other kinds of diseases for other people.


Using seven dates has a spiritual and material significance. Allah Has Created seven heavens, seven earths, seven days in the week and Made the creation of mankind pass through seven stages. In addition, Allah Made the Tawaaf seven circumambulations; and the Sa'ee as seven trips between Safa and Marwah. In addition, the Jamraat are stoned with seven pebbles each. Prophet Muhammad Sallallaho Alaihe Wasallam said about young children,


"Command him to pray upon reaching the age of seven".



In addition, when the child reaches the age of seven, he is given the choice between his father and mother, according to some opinions. When our beloved Prophet was ill, he ordered that water be poured on him from seven different water skins. Allah Has Sent the destructive wind on the people of Aad for seven consecutive nights. Furthermore, when Allah Gave the example of charity, He compared it to a grain (of corn); it grows seven ears, and each ear has a hundred grains. In addition, the ears of corn that the king saw during the time of Prophet Yusuf (Joseph) were seven and the number of the years during which the king’s people would farm the land was seven. Charity is multiplied seven hundred times to much more. Further, there are seventy thousand members of the Muslim Ummah (Nation) who will enter Jannah (Paradise) without questioning. The number seven has a special significance more than other numbers and only Allah Has full knowledge of the wisdom behind choosing this number above other numbers.


The Hadith mentioned that eating seven dates from a certain area in Madinah prevents poisoning and magic, indicating the special qualities of this type of date. Had it been Hippocrates or Galinus who issued this statement rather than the Prophet, the doctors would quickly accept the statement without question, even though they would be issuing it based on guessing and not on fact. The statements that come from our beloved Prophet, whose words are certainly true and divinely revealed, deserve to be believed in more and submitted to, without any hesitation or denial.


The dried dates mentioned in Hadith are being useful against certain poisons. Furthermore; we should state here that it is a condition that the sick person should believe that the medicine will help him, so that his body accepts it and benefits from it. It is a fact that sometimes (merely believing), the medicine will help cure some ailments, as many people have witnessed in this regard. When the heart accepts that a certain medicine carries the cure, the body will feel an elevation in its strength and in the instinctive heat that will help the body get rid of and extract out the harmful substances. On the other hand, sometimes an effective medicine fails to work because the patient does not believe that it will cure him, and consequently, his body neither accepts it, nor benefits from it.


Even the Quran, which is the best, most beneficial remedy ever, both in this life and in the Hereafter, and which is a cure for every disease, will not benefit the heart that does not believe in its value as a cure and a remedy. Rather, the Quran only adds more disease to such evil hearts.


There is not a more effective cure for the diseases of the heart than the Quran, for it completely eradicates the ills of the heart, preserves the heart’s health and wellbeing and defends it against all that might bring harm to it. Yet, most of the hearts ignore the Quran and do not believe in it, and thus refrain from using it. Instead, such people refer to other types of medicine that were prepared by their like from among mankind, thus preventing their hearts from benefiting from the Quran. Consequently, the symptoms that attacked their hearts will persist and will expose their hearts to even more ailments. By the passage of time, both the doctors and the patients will get used to the medicines produced and prescribed by their like, leaders, or those whom they respect. In this case, disasters will accumulate and the diseases will become harder to cure. And the more they (those who ignore the Quran) use these medicines, the more strength they will add to the ailment.

فى "الصحيحين" من حديثِ عُرْوةَ، عن عائشةَ: أنها كانتْ إذا ماتَ الميتُ من أهلِها، واجتمع لذلك النساءُ، ثم تفرَّقْنَ إلى أهلهن، أمرتْ ببُرْمَةٍ من تَلْبينةٍ فطُبِخَتْ، وصنعت ثريداً، ثم صبَّت التلبينةُ عليه، ثم قالت: كُلوا منها، فإنى سمعتُ رسول الله صلى الله عليه وسلم يقول: "التَّلْبِينَةُ مَجمَّةٌ لفؤادِ المريضِ تَذهبُ ببعضِ الحُزْن ".



In the Sahihain, it is narrated that Aishah Radi Allaho Anha said that when a relative of hers would die, the women would gather on that occasion and then would depart except for her family members and close associates. She would then order that TALBINAH (milk soup) be prepared. Then, Thareed would be made and she would pour the milk soup on it. Aishah Radi Allaho Anha would then ask them to eat saying, I heard the Messenger of Allah saying:


"TALBINAH (milk soup) brings relief to the heart of the sick and takes away some of the anguish".



وفى "السنن" من حديث عائشة أيضاً، قالت: قال رسولُ الله صلى الله عليه وسلم: "عليكُمْ بالبَغيضِ النَّافع التَّلْبِينِ"، قالت: وكان رسولُ الله صلى الله عليه وسلم إذا اشتكَى أحدٌ من أهله لم تَزلْ البُرْمةُ على النارِ حتى ينتهىَ أحدُ طرَفَيْهِ. يَعنى يَبْرَأ أو يموت



Aishah Radi Allaho Anha also narrated that the Messenger (Sallallaahu Alaihe Wasallam) said, "You should eat the beneficial thing that is unpleasant to eat (Talbina). If any member of the Messenger of Allah's family was sick, the cooking pot would remain on the fire until one of two things happened, either the person recovered or died." 
[Ibn Maajah (3446)].


وعنها: كان رسولُ الله صلى الله عليه وسلم إذا قيل له: إنَّ فلانَا وَجِعٌ لا يطْعَمُ الطَّعَامَ، قال: "عَلَيْكُم بالتَّلْبِينَةِ فحُسُّوه إيَّاها"، ويقول: "والذى نفْسى بيدِه إنَّهَا تَغْسِلُ بَطْنَ أحدِكُم كما تَغسِلُ إحداكُنَّ وجهَها مِنَ الوَسَخ".



Whenever Prophet Muhammad Sallallaho Alaihe Wasallam was informed that a certain person was suffering with pain & would not eat the food, he said "You have the Talbinah (with husk & milk), give it to the sick person". And then he said " For by the One in Whose Hand Muhammad's soul is , it cleans the stomach of one of you just as dirt is cleaned from the face with water." [Mustadrak ].


TALBINAH means the kind of soup that is similar to milk in consistency. This is a beneficial food suitable for the sick, especially when well cooked until acquiring a soft consistency. The milk like soups, are as beneficial as barley soup, even better. Barley soup is made of whole barley grains, while the milk like soup is made of ground barley flour with its bran.



Whole grain barley soup digests quickly, provides good nutrition, and cleanses the stomach, especially when taken while it is still hot. In this case, its cleansing and digestive qualities are stronger and the soup will develop its instinctive heat quicker and will soften the outer layers of the stomach.


Our beloved Prophet’s statement that TALBINAH takes away some of the sadness refers to the effect of sadness on the mood and in weakening the instinctive well being, which in turn affects the soul and the heart. Talbinah brings strength to one’s inner energy and thus the body will be able to rid itself of the sadness and grief that took it over.


We could say that some foods bring relief to the heart, such as the type of soup mentioned above, because they posses a special quality that effect people’s mood and brings them relief and comfort. Allah knows best.


We might in addition say that the sick person's strength becomes weaker because of his grief and sadness that will translate to dryness in the body and the stomach due to the scarcity of food. Talbinah brings wetness and strength to the stomach, which will bring relief to the heart. Furthermore, the sick person may complain from an accumulation of harmful flatulence or phlegm in his stomach. Talbinah will dissolve these harmful substances or dilute them, so that the pain and harm they cause are diminished, especially for those accustomed to eating barley bread, such as the people of Madinah Munawwarah. During that time, barley bread was the staple diet for the people of Madinah as wheat was scarce at that time.
